I am a homeowner with a mortgage serviced by Shellpoint Mortgage. In early XXXX, I was blindsided by a drastic increase in my monthly mortgage payment-from around {$1100.00} to nearly {$2000.00} per month-due to an unexpected {$40000.00} water bill being added to my escrow account. This increase caused me to fall behind on my payments, as I was not given advance notice or a clear explanation prior to the adjustment.
I sent a Qualified Written Request ( QWR ) via certified mail on XX/XX/year>, asking for a detailed explanation of the charges. I also called Shellpoint on the same day and was told I would need to pay {$6000.00} by XX/XX/year>, plus {$2000.00} per month going forward. When I requested options to bring the loan current ( such as forbearance, repayment plan, or loan modification ), I was told that no alternatives were available.
Shellpoint has been uncooperative and dismissive. Their representatives have not provided written breakdowns, alternate options, or support despite my good faith efforts. Their demand for a {$6000.00} lump sum-especially when tied to an escrow-related charge I was unaware of-feels predatory, unrealistic, and unsustainable.

Newrez LLC Mortgage XXXX is forcing me to pay for lender-placed insurance and escrow, although the building I live in is a co-op building and I already pay maintenance fees to the building 's corporation, which include taxes and my share of the entire building 's insurance. In essence, now there are two policies which is also against insurance stacking benefits regulations in NY.
I have spoken with them several times, and even sent them a copy of the master certificate of insurance covering the property from the building corp. Keep in mind, I am a shareholder, and that a coop is not real property.
They do not listen, and they make communication with them extremely difficult.

The companys response fails to address multiple critical legal violations outlined in my original affidavit. I will not accept evasive, incomplete, or unsupported answers. The following issues remain unresolved : Blatant Disregard for the Arbitration Clause and Contractual Violations Despite clear references to the binding arbitration clause in my complaint, Wells Fargo continues to pursue foreclosure in direct violation of this legally binding agreement. This is an overt violation of the Federal Arbitration Act ( 9 U.S. Code 1 et seq. ), and the company 's refusal to honor this provision is unacceptable. I demand the immediate cessation of all foreclosure activities until the matter is resolved through arbitration, as is explicitly required by the contractual terms.
Failure to Acknowledge UCC Claims & Secured Party Status I have provided irrefutable evidence of my UCC-1 Financing Statement and my status as a secured party. Wells Fargo 's failure to acknowledge this fact is a deliberate oversight that undermines my legal rights under UCC Article 9. Their refusal to address my secured party status is a gross violation of my rights. I will not accept any further delay or dismissal of my rightful claim.
Neglect of TILA Violations The Truth-in-Lending Act ( TILA ) violations I raised were entirely ignored in Wells Fargos response. This is not a trivial matter. TILA mandates accurate and truthful disclosures regarding the terms of a mortgage. The company has failed to provide any substantive response to the violations outlined, which constitute serious legal breaches. I demand a thorough investigation into these violations and the immediate rectification of any misleading disclosures.
Complete Ignorance of Mortgage Audit Findings ( Exhibit A ) The mortgage audit I submitted, which revealed significant discrepancies, was completely disregarded in their response. Wells Fargos refusal to address the discrepancies outlined in Exhibit A is a blatant attempt to avoid accountability. I demand that Wells Fargo provide a full, point-by-point response to the audit findings, including a detailed explanation of the discrepancies and their plan for correction.
Failure to Correct Credit Reporting Inaccuracies The companys claim that foreclosure reporting ceased due to obsolescence is nothing more than a diversion from the fact that their initial reporting was entirely invalid. The timeline of default and the outstanding balance were misreported, and Wells Fargos failure to address these inaccuracies is unacceptable. I demand an immediate correction to my credit report, with all invalid public records removed, and an accurate account status reflected.
Immediate Demands for Resolution : Given the company 's complete failure to address these legal violations, I am demanding the following : Immediate cessation of all foreclosure actions pending arbitration review, as required by the binding arbitration clause.
Formal acknowledgment of my secured party status and validation of the UCC-1 filings I have made.
Full investigation into TILA violations, including the correction of any misleading disclosures.
Full resolution of all discrepancies identified in the mortgage audit, with a detailed explanation of corrective actions.
Immediate correction of my credit report to reflect the true status of my account, including the removal of all invalid public records.
Failure to address these demands will leave me no choice but to escalate this matter further, including through legal channels. I will not tolerate any further delays or attempts to circumvent my legal rights. I am prepared to pursue every avenue available to me to ensure that Wells Fargo is held fully accountable for their actions.
